STANDARD TERMS & CONDITIONS

1. Offer and acceptance of a place in the nursery

Parents wishing to place their child's details on our waiting list need to return a completed registration form together with the non-refundable registration fee.

2. Registration Fee

The registration fee (see fee schedule) is payable on receipt of the completed registration form, and is non-refundable.

3. Fees and Extras

  • Fees cover the normal care and educational activities for the duration of the published opening hours, including extra curriculum activities such as music, French lessons and most trips.
  • The fees include all relevant hot meals, milk, water, juice and snacks.
  • Nappies, creams, lotions etc are not included.

Payment of Fees and Extras

  • Fees due must be paid in advance, on the first day of each month or week.
  • Fees are fully payable during the nursery closure periods and bank holidays.
  • Unfortunately, there are no refunds or reductions or waivers of fees because of absences, however caused.
  • Parents are normally invoiced each month, but the normal monthly payment should not be withheld while awaiting receipt of an invoice.
  • If fees are unpaid at any time, the nursery reserves the right to refuse entry to a child.

Responsibility for payment

Fees are the joint and several responsibilities of the parents.

Unpaid fees

  • Under normal circumstances, if fees are not paid by ten days after the due date, a child will be excluded from the nursery and the place canceled.
  • Dishonoured cheque payments will need to be replaced by cash payment or a direct transfer within 24 hours.
  • Unpaid fees will be recoverable by court action if necessary.

Fees for late pick-up of children

The nursery will make a charge if a child is collected late. The current rate is £1 per one minutes, which goes towards the extra costs of caring for the child (staffing, heating/lighting etc).

Review of fees

To maintain our quality standards, it may be necessary to revise the nursery fees, and at least one month’s advance notice will be given before any changes are implemented.

4. Changes in child’s attendance at the nursery

Cancellation of acceptance

A month’s fees in lieu of notice will be payable by the parents if, for any reason, they cancel their acceptance of a place or the child does not join the nursery after a place has been reserved by the nursery and accepted by the parent. Cancellation must be given in writing and acknowledged by the nursery at least one month before the child's start date to avoid these charges.

Withdrawal from the nursery

A place can be terminated at any time by either the parent or nursery, subject to one calendar month’s advance written notice. Notice must be given in writing and an acknowledgment letter confirming the child’s last day will be issued to the parent by the nursery.

Decrease In attendance

Decrease of attendance must be requested in writing and is permitted at the discretion of the Head of Nursery and the same notice period will apply as in withdrawal from the nursery.

Changes to, or Increase in attendance

Increase in attendance, or changes to days attended must be requested in writing and is permitted at the discretion of the Head Of Nursery.

Non attendance

If a child does not attend for two weeks, unless informed to the contrary, the nursery will assume that the child has left without notice and the place canceled. The last day of the two-week non-attendance period will be taken, as the last day of attendance and an invoice will be issued to include fees for one calendar month from the last day of the two week non-attendance period.

Change of child’s attendance by the nursery

In the case of part-week children, the Head Of Nursery reserves the right to alter days of attendance or to decrease the attendance pattern of a child should it be deemed necessary for the efficiency of the nursery. One month’s written notice will be given.

Termination of child’s place by the nursery

The nursery reserves the right to terminate a child’s place in the nursery at any time, without notice. This will only be done if the nursery decides that this course of action is in the best interests of the children and staff. All outstanding fees up that point will be payable in full. Any overpayment will be promptly refunded. Reasons for termination under this clause include; persistent and uncontrollable antisocial behaviour by parent or child; irrecoverable breakdown in nursery/parent relationship; a child persistently causing harm to other children or staff e.g. by biting or scratching.

5. Miscellaneous terms and conditions

Parent's Authority

The parents authorise the Head of Nursery while in loco parents to take and/or authorise all decisions that safeguard and promote the welfare of the child. Parent’s consent to such physical contact with the pupil as may be lawful, appropriate and proper for care and teaching and to provide comfort to a child in distress or to maintain safety and good order (we do not use corporal punishment).

Relationship with nursery staff

Parents must not approach nursery staff to work for them on a private basis, in any capacity. If a parent employs a member of nursery staff either directly or indirectly, resulting in the member of staff leaving their employment at the nursery, the parent will be liable for an introductory charge, being 25% of the employees current salary.

Liability

The nursery does not accept responsibility for accidental injury or loss of property on any nursery premises, including car-parking areas, unless caused by its negligence.

Publicity material

  • The nursery prospectus and other publicity material describe the broad principles on which the nursery is presently run and gives an indication of our history and ethos. It does not form part of this agreement.
  • Parents wishing to place specific reliance on a matter given in the prospectus or any publicity material should seek written confirmation of that matter before entering this agreement.

Waiver and termination

  • Any waiver of any of these terms and conditions is effective only if given in writing by the Head Of Nursery.
  • The nursery may terminate this agreement on one month’s written notice or under the termination clause contained under Section

Consumer protection

If any word/s in these terms and conditions, alone or in combination, infringe the Unfair Terms In Consumer Contracts Regulation 1994 or any other provision of law, they shall be treated as severable and shall be replaced with words, which give, as nearly as possible, the original meaning.

6. Interpretation

  • The nursery means Russell Hill Road Day Nursery
  • The Head of Nursery means the person appointed by the owner to be responsible for the children and staff and includes any other person to whom any of the duties of the Head of Nursery has been responsibly delegated.
  • The parent means each person who has signed the acceptance form or who has parental responsibility.
  • Notice means (unless the contrary is stated in these terms and conditions) a month’s written notice delivered to and actually acknowledged in writing by the Head of Nursery.
  • A month means a calendar month (e.g. from 4th May to 3rd June).
  • Fees in lieu means fees in full for the term of notice at the rate that would have applied had the child attended.
